公務人員於上下班途中發生交通事故，無公務人員撫卹法施行細則第12條所定交通違規情事，至警察機關製作筆錄、各地方調解委員會進行調解，或應司法機關傳會出庭，得由服務機關覈實核給公假；所稱上下班途中之認定，依公務人員撫卹法施行細則第10條相關規定認定。
